Vermeer AI provides tools to generate and edit images using artificial intelligence, including text-to-image, image-to-image, background removal, upscaling, face swap, and related features. Features, models, and limits may change over time.

4. Accounts and Registration

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to verify your email address when prompted. Notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

• Is unlawful, infringing, defamatory, or violates the rights of others, including intellectual property and privacy rights.
• Depicts sexual content involving minors, or non-consensual, deceptive, or harmful impersonations of real people.
• Promotes violence, harassment, hate, or illegal activity.
• Attempts to reverse engineer, overload, disrupt, or gain unauthorized access to the Service or its systems.

6. User Content and License

You retain ownership of the prompts and images you submit ("User Content"). You grant us a limited license to host, process, and transmit your User Content solely to operate and provide the Service. You represent that you have the necessary rights to your User Content.

7. Ownership of Generated Content

Subject to your compliance with these Terms and applicable law, you own the images you generate with the Service. Commercial usage rights are granted as described on our Pricing page; the free plan is intended for personal, non-commercial use. You are responsible for how you use generated content.

8. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding User Content and generated images), is owned by Vermeer AI and protected by law. These Terms do not grant you any right to our trademarks or branding.

9. Plans, Credits, and Billing

The Service offers free and paid plans. Paid plans and credits are described on our Pricing page. Fees are billed in advance and all sales are final. You can change or cancel your plan at any time, with the change taking effect at the end of the current billing cycle.

10. Third-Party Services

The Service relies on third-party providers (for example, AI model providers, email, and hosting). We are not responsible for the availability or practices of third parties, and your use of those components may be subject to their terms.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements or be free of third-party claims.

12. Limitation of Liability

To the maximum extent permitted by law, Vermeer AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Vermeer AI from any claims, damages, and expenses arising out of your User Content, your use of the Service, or your violation of these Terms or the rights of others.

14. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that may harm us or others. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination will survive.

15. Governing Law and Disputes

These Terms are governed by applicable law without regard to conflict-of-laws principles. Disputes will be resolved in the courts of competent jurisdiction, unless otherwise required by mandatory local law.
